In making this Submission and accepting the terms herein, You represent and warrant that You have the sole and exclusive authority to use and submit any copyrighted material incorporated into the Submission. JCMI reserves the right, in its sole discretion, to refuse any Submissions containing material that is obscene, crude or vulgar; or that contains gang identification, references to commercial products, license plate numbers, phone numbers, personal addresses (physical or email), Web site URLs, derogatory characterizations of any ethnic, racial, sexual or religious groups, references to illegal or inappropriate activity, behavior or conduct, or any other references that could be considered inappropriate, unsuitable or offensive. You hereby grant JCMI and its affiliated companies the right to use, without compensation owed, Your submission, name, likeness, picture, address (city and state), voice, biographical information, application materials, entry form information and any written and oral statements provided in association with the Submission, for purposes of advertising and promoting JCMI's products and services. You shall have no right of approval, no claim to compensation, and no claim (including, without limitation, claims based on invasion of privacy, defamation, or right of publicity) arising out of any use, blurring, alteration, or use in composite form of your name, picture, likeness, address (city and state), e-mail address, biographical information, or entry. In submitting Your Submission, You further warrant and represent that You have the full power and authority to use Your name, likeness, imagery, photography, or other such material included in the Submission. You hereby agree to release and to indemnify and hold harmless JCMI, its parent and affiliated companies, and each of its or their respective officers, directors, employees and agents (collectively, the "Released Parties") from any claim, actions, rights, liability, injury, death, loss or damages to You or any other person or entity, including without limitation, claims of third party intellectual property infringement. This release shall include, but shall not be limited to, actions arising out of any claim of copyright or trademark infringement made as a result of content in Your Submission. You warrant and represent that You are at least eighteen (18) years of age at the time You submit your Submission. All trademarks and trade dress of JACKSON musical instruments used in connection with Your Submission (including without limitation, the distinctive headstock and body designs of said guitars) remain the sole and exclusive property of JCMI, Inc. Any time estimate of project completion provided by JCMI, is an estimate only. JCMI reserves the absolute right to change prices with or without prior notice. The time estimate is not binding, may be subject to change, and assumes no changes in specifications, part sourcing issues or delays that are unforeseeable and/or not caused by JCMI. Changing, or adding to specifications may require a reassessment of the project which could further impact timing and/or cost. Any acceptance by JCMI of Your Submission does not constitute a legally binding contract, and purchase of product shall only occur when and if Customer pays in full as instructed. In the event of any cancellation, refusal or suspension of any order or sale arising directly or indirectly from Your Submission, your sole and exclusive remedy shall be limited to a refund of an amount no greater than any amount actually paid by You, and JCMI shall have no liability whatsoever for consequential, special, or indirect damages.
